THE=20 CORPORATION OF THE DISTRICT OF NORTH VANCOUVER

BYLAW = 6966

A=20 bylaw to regulate the = carrying on=20 of pet shop businesses in the District of North Vancouver for the = purposes of=20 preventing cruelty to animals and protecting the public by preventing = and=20 minimizing nuisances and misleading business practices=20 pursuant to sections 704 and 679 of=20 the Municipal Act (RSBC = 1996,=20 c.323)

=20 The Council for The Corporation of the District of North = Vancouver enacts=20 the following:

Title

Interpretation

=20 =93cage=94 means a kennel, pen, tank, or any other container = or enclosure used or intended to = be used to=20 confine animals.

=20 =93inspector=94 includes = Animal=20 Control Officers, Bylaw Enforcement Officers, Property Use Inspectors = and Business Licence=20 Inspectors.

=20 =93pet=94 means any animal kept =20 by a person for = purposes=20 other than for food or other utility.

=20 =93pet shop keeper=94 means any owner, operator or any other = person who is in charge of a pet=20 shop.

=20 =93veterinarian=94 means a person registered as such under the = Veterinarians=20 Act.

=93wild=20 animal=94 includes any animal, except fish, that lives in the wild, or = does not=20 customarily live = and breed in=20 captivity. =20

Business Licence = Required

3. A pet = shop keeper=20 shall comply with, and be licenced pursuant to, the Business Licence=20 Bylaw.

Duties of Pet Shop = Keeper

(a) ensure that all persons who = attend to the=20 care of animals have the skill, knowledge, ability and supplies = necessary for=20 the proper care of such =20 animals;

(b) protect all animals from = unsupervised=20 viewing or handling by members of the public;

(c) provide all animals with = sufficient food,=20 water, shelter, warmth, lighting, cleaning, sanitation, exercise and any = other=20 care required to maintain the health, safety and well being of such=20 animals.

Pet=20 Shops & Cages

5. A pet = shop, cage or other place where = animals are=20 kept shall be maintained

(b) clean, sanitary and free of = soiled=20 material, excrement and offensive odours; and

(a) be proportionate in size to = the size and=20 species of animal and which allows room to stand to its full height, = move with=20 ease, lie in a fully extended position, and perform any other normal = postural or=20 behavioural movement;

(c) except for bird cages, have = floors with=20 an impermeable surface and of solid construction which will support the = animal=92s=20 weight without bending;

(d) in the case of birds, have = removable=20 impermeable bottoms, and be of sufficient size to enable each bird = sufficient=20 space for full extension of its wings in all directions while all birds = are=20 perched.

Segregation of Ill or Injured=20 Animals

7. A pet = shop shall=20 contain an area suitable to segregate animals, which may be injured, = ill, in=20 need of special care, = treatment or=20 attention, from other animals in the pet shop.

Veterinary Care

(a)=20 in a conspicuous place accessible to all employees of the pet shop, post = the=20 name and telephone number of a veterinarian who may be contacted to = provide all=20 necessary veterinary services;

(b)=20 ensure the prompt examination and treatment by a veterinarian of any = animal=20 which is ill or has been injured;

(d)=20 ensure that any necessary euthanasia and disposal of an animal is = performed by a=20 veterinarian.

9.=20 A = pet shop=20 keeper shall keep and maintain, on the pet shop premises, a legible pet = shop=20 register containing a record of all transactions where animals have been acquired or = disposed=20 of by the pet shop.

(c) in the case of transactions = involving=20 dogs or cats, contain a description of the animal including its sex, = colouring,=20 markings, tattoos, age, breed or cross breed;

(d) in the case of animals other = than dogs=20 and cats, contain the number and the species of animals contained in = each=20 shipment;

(e) in the case of a purchase or = other=20 acquisition of an animal, contain the name and address of the supplier = or person=20 from whom the animal was otherwise obtained;

(f) in the case of a sale or = other=20 disposition of an animal, contain the name and address of the purchaser = or=20 person who obtained custody of the animal from the pet=20 shop.

Inspection of = Register

11. Upon the = request of an=20 inspector a pet shop keeper shall produce the pet shop register for = inspection=20 and shall provide copies of any entries which the inspector may=20 require.

Information Provided to=20 Purchasers

12. A pet shop = keeper=20 shall, at the time an animal is sold, provide the purchaser with a = written=20 description of the animal and the document shall = include:

(d) in the case of a dog or a cat, = a=20 description of a tattoo, breed or cross breed, a record of all = vaccinations and=20 a certificate verifying the animal=92s health which shall be dated and = signed by a=20 veterinarian.

Public Notices to be = Posted

13. A pet shop = keeper=20 shall, in a conspicuous place within the pet shop, display for public = viewing, a=20 notice containing a written description of each animal, its country of = origin=20 and the name and address of the breeder or supplier of each animal kept = in the=20 pet shop.

Prohibitions

(c) any animal to be sold or = offered=20 for sale if its colour has been altered or enhanced with dye, whether = applied=20 externally or by ingestion;

(d) any animal to be sold or = offered at=20 a discounted price, as a sales promotion or as a bonus to the sale of any other goods or=20 services;

(e) any wild animal to be = sold, offered=20 for sale, or displayed to the public;

(f) an animal to be sold or = offered for=20 sale which suffers from = or exhibits=20 signs of

Enforcement

15. = An=20 inspector may enter a pet shop at all reasonable times to ascertain = whether the=20 requirements of this Bylaw are being met.

16. = No person=20 shall prevent, obstruct, or impede an inspector from entering a pet shop or from enforcing any = provision of this=20 Bylaw.

Offence

(b) causes, suffers or permits = anything to be=20 done in contravention of this Bylaw, =20 =

commits=20 an offence and is liable to a fine of not more than $2,000.00 and not = less than=20 $100.00.

Designation for Municipal=20 Tickets

18. = This=20 Bylaw is designated pursuant to section 934.1 of the Municipal Act as a Bylaw that = may be=20 enforced by means of a ticket in the form = prescribed.

Designation of Bylaw Enforcement=20 Officer

19. =20 Inspectors and members of the Royal Canadian Mounted Police are=20 designated to enforce this bylaw by means of a ticket pursuant to = section 934.1=20 of the Municipal=20 Act.
