VANCOUVER/CKNW(AM980) - The Vancouver Park Board is in some hot water over a mammal in some Park water.

Hana is one of the Aquarium's dolphins, and according to the Board's own bylaws, she is there illegally.

Bylaw 9 (e) says nobody can keep a cetacean mammal, whales and dolphins, on park grounds.

Of course there are some in the Aquarium now, but they fall under several exceptions to the law.

According the group of Coalition For No Whales In Captivity lawyers at the Committee meeting Tuesday evening, Hana does not. One of those lawyers was Denis Howarth. He says the Board must prosecute its tenant, "It is the duty of the Board as a legislative and administrative government over Parks, when a bylaw has been broken, when it has been proven to the Board that it has been broken, when their own staff says it has been broken, it's their duty to prosecute."

The Park Board passed the issue over to staff for further research in an effort to avoid litigation.
