Ms. Sellin,
Provincial laws of general application apply of their own force on reserve provided they are not inconsistent with subsection 35(1) of the Constitution Act of 1982 and that they do not conflict with the provisions of the Indian Act.
The Criminal Code and its applicable regulations is an Act of the Federal Government and applies on reserve.
Also, provincial laws of general application may co-exist with any other laws unless they:
a) affect land,
b) interfere, without jurisdiction, with existing treaty or aboriginal rights, or,
c) are inconsistent with the Indian Act or its regulations or any Act of Parliament.
Should you require further information, please contact your local RCMP detachment.
Respectfully yours,
James Westhaver
