SPCA makes illegal seizures: Legal opinion and Regina vs Ann Brown *LINK* *PIC*

Under the rule of the latest CEO, Craig Daniell, the BC SPCA is making what are almost certainly illegal seizures of animals. This has been proved in Surrey Provincial Court in 2000: See Regina vs Ann Brown http://www.animaladvocates.com/ILLEGAL-SEIZURES/Regina-vs-Ann-Brown.htm.

Regina vs Ann Brown (Surrey provincial Court, 2000) established that the SPCA must permit the owner to remedy alleged deficiencies before obtaining a Warrant to seize. The SPCA does not always do this.

Some SPCA's seizures are an infringement of a person's Charter right to reasonable search and seizure and privacy. The SPCA illegally seized some of Ann Brown's horses, and before the case went to trial, some of the horses died while in the SPCA's "care". The SPCA also made this seizure with its gaggle of media friends in tow and Judge MacDonald took a dim view of that trick. The SPCA still specializes in "media" seizures.

The PCA Act says the SPCA must give an animal's owner the opportunity to correct what the SPCA alleges are deficiencies before making a seizure, yet the SPCA ignores the law all the time and illegally seizes healthy animals.
