One thing you forgot to mention.
If the owner is charged by the SPCA under the PCA act then they have a day in court. It seems that a lot of people were winning their cases so the SPCA is not charging them. This forces the case into Civil court - a totaly different set of rules. I am not a lawyer but have learned over the past 7 months that unless you have pockets as deep as the SPCA you may have a problem. Constant delaying tactics seem to be the order of the day.
