SPCA drags horses into filthy trailer *LINK* *PIC*

Court affidavits
A very sharp image of the society's hired truck driver and assistant dragging and pushing Fairfax, a three month old chestnut colt, into the trailer when they seized him at on December 2, 2003. This was Exhibit BB in John's Affidavit # 1. John describes the trailer as a "filthy trailer, dangerous to the health of the three young horses transported within it."

Van1.jpg: An image of John pointing to the trailer in which the Society's hired truck driver transported the three young horses. This was Exhibit CC to John's Affidavit #1

John had this to say about Exhibits BB and CC in his affidavits:

"1. The horse trailer into which the truck driver and his assistant loaded Tinker, Star, and Fairfax was filthy, with several inches of feces in the bottom of the trailer as shown in Exhibits BB and CC to my Affidavit #1.

2. I never transport my horses in such a filthy horse trailer as in my opinion it is unhealthy and dangerous to transport animals in a horse trailer in such a filthy condition.

3. The three young horses are not halter broken and are not accustomed to being dragged on a rope or being handled or having their legs and feet handled.

4. I observed that the truck driver and his assistant dragged Fairfax on to the horse trailer by a halter and rope as shown in Exhibit BB to my Affidavit #1.

5. I never drag my horses in that fashion as in my opinion dragging a horse on to a horse trailer can result in injury to the horse's neck or leg.

6. I observed that there were portable gates on both sides of the inside of the horse trailer, as shown in Exhibits BB and CC to my Affidavit #1, although such gates are normally hung up on the outside of the trailer.

7. In my opinion portable gates on the inside of a horse trailer with horses in the trailer constitute a hazard to the horses and can result in injury to the legs of the horses."
