A Courtenay couple do not contest an order that their two-year-old dog be destroyed.

'In reference to our scheduled court appearance of Aug. 15, 2002, we will not be appearing or disputing the matter of the regional district and SPCA in an order to destroy our dog,' the owner Angela Barry, wrote in a letter to the court.

The black and tan coloured Rottweiler/Shepard cross was captured in early July after it bit a woman walking by the property where the dog was kept. The bite punctured the skin on her upper left thigh.

The dog was deemed likely to kill or injure a person or domestic animal and the request was granted in provincial court last Thursday to have the dog destroyed.

After reviewing the evidence, Barry said they didn't want to take any chances that the dog would hurt someone else.

'We decided that she needed to be put down,' Barry said, in an interview Monday afternoon. 'We didn't want to put anyone at risk.'

Earlier this year, the dog, without provocation, had rushed at a man as he walked past the property. The man avoided injury by putting his bag between himself and the dog. Barry was advised to take precautions to make sure the dog didn't attack or bite anyone else.

After it succeeded in biting a person the dog was taken into custody and the request was made to have it destroyed."

Whether you believe it or not, I am sad that this happened to Josie. In a controlled situation she was a good dog. Her weakness was that she was territorial. Angie admitted this in her first post. There are many dogs out there like Josie. The owners need to ensure that they keep such dogs contained and under control. THEIR DOG'S LIFE DEPENDS ON IT!
