Notes to the transcript (1) The time line of inspections and seizure

Two complaints dated: February 26th, 2003, and March 29th, 2003

First Inspection, Offence Warning Notice issued: February 25th of 2003 (Note: the inspection was made on a complaint that was made after the inspection)

Second Inspection, no Notice issued: March 10th, 2003

Third Inspection, no Notice issued: March 21st, 2003

Seizure: March 27th 51 dogs and pups and six horses

Note: The SPCA's vet, Dr Teresa Jacobson, recommends immediate euthanasia of a horse (called in court "Sully") even though SPCA Special Provincial Constable Kathy Woodward's notes say Sully had gained weight between inspections and before the seizure! Yet SPC Kuich kept saying in court that there had been no improvement in Sully's condition. These two worked together on this case but contradict each other.

Note also: The SPCA chased a horse into a bog and it had to be pulled out.

Note: I do not defend Douglas and Hill, but the way the SPCA abuses its statutory power is even more indefensible. Linda Douglas told me that the SPCA sold 51 expensive dogs and pups plus an unknown number of pups born after the seizure. It sold the six horses, two of which were in foal so they sold the foals too. Then it started a law suit to get $19,000 from Douglas and Hill for its "seizure costs". The SPCA has never pursued the suit for its seizure costs (since the case was stopped by the Crown midway through the trial), but nor has it had the grace to drop the suit, it is just letting it sit in Supreme Court. In fact, the SPCA has not had the grace to drop the failed criminal trial either. Crown only stayed it, which is ridiculous, as if this case would ever be winnable after the Mickey Mouse way the SPCA's "trained" Constables screwed it up.

Note: Even though the Hill/Douglas's farrier was right there trimming the horses' hooves when the SPCA showed up for the first inspection, Kuich wrote on his "Cruelty Complaint" form that the horses hooves were overgrown and had to be attended to!
